Module 8: Elder Abuse & Mandatory Reporting

⚠️ YOU ARE A MANDATED REPORTER

Illinois law requires you to report suspected elder abuse within 24 hours.

Failure to report is a Class A misdemeanor punishable by up to 1 year in jail and $2,500 fine.

1. Types of Elder Abuse

Physical Abuse

Definition: Intentional use of force causing injury or pain

Warning Signs:

  • 🔴 Unexplained bruises, burns, or welts
  • 🔴 Fractures inconsistent with reported fall
  • 🔴 Signs of restraint (rope marks, bruises on wrists/ankles)
  • 🔴 Client appears fearful around caregiver or family member
  • 🔴 Sudden change in behavior when certain person enters room
  • 🔴 Over-sedation or misuse of medications

Emotional/Psychological Abuse

Definition: Verbal or nonverbal acts causing emotional distress

Warning Signs:

  • 🔴 Client becomes withdrawn, anxious, or depressed
  • 🔴 Unusual behavior (rocking, biting, sucking)
  • 🔴 Reports being yelled at, threatened, or humiliated
  • 🔴 Caregiver isolates client from friends/family
  • 🔴 Observed verbal abuse: insults, threats, intimidation

Financial Exploitation

Definition: Illegal or improper use of elder's funds or property

Warning Signs:

  • 🔴 Sudden changes in bank accounts or will
  • 🔴 Unpaid bills despite adequate income
  • 🔴 Missing cash, jewelry, or valuables
  • 🔴 Forged signatures on checks or documents
  • 🔴 New "friend" suddenly managing finances
  • 🔴 Client lacks knowledge of their financial situation
  • 🔴 Unexplained ATM withdrawals

Neglect

Definition: Failure to provide necessary care, assistance, or protection

Warning Signs:

  • 🔴 Poor personal hygiene, dirty clothing
  • 🔴 Bedsores, untreated wounds
  • 🔴 Malnutrition, dehydration
  • 🔴 Unsafe living conditions (no heat, pests, filth)
  • 🔴 Unmet medical needs (missed appointments, unfilled prescriptions)
  • 🔴 Left alone when supervision needed

Sexual Abuse

Definition: Non-consensual sexual contact of any kind

Warning Signs:

  • 🔴 Bruises around breasts or genitals
  • 🔴 Unexplained STDs or infections
  • 🔴 Torn, stained, or bloody underclothing
  • 🔴 Client becomes withdrawn or fearful
  • 🔴 Sudden behavior changes around certain individuals

2. How to Report Suspected Abuse

Reporting Flowchart:

  1. Observe/Suspect Abuse → Document what you see/hear objectively
  2. Notify Supervisor Immediately → Within 24 hours
  3. Call IDoA Hotline → 1-866-800-1409 (available 24/7)
  4. Complete Incident Report → Written documentation required
  5. Cooperate with Investigation → Provide information as requested

What Information to Provide:

  • Client's name, address, phone number
  • Nature and extent of suspected abuse
  • When did you observe it?
  • Specific details: injuries, statements, behaviors
  • Name of suspected abuser (if known)
  • Any immediate danger?
  • Your name and contact information

3. Legal Protections for Reporters

You Are Protected By Law:

  • ✓ Immunity: Cannot be sued for good faith reporting
  • ✓ Confidentiality: Your identity is protected
  • ✓ Anti-Retaliation: Employer cannot fire you for reporting
  • ✓ No Proof Required: You only need reasonable suspicion, not proof

Better to report and be wrong than not report and client remains in danger.

4. Documentation Guidelines

DO:

  • ✓ Document exact date and time of observation
  • ✓ Use objective, factual descriptions
  • ✓ Quote client's exact words when possible
  • ✓ Describe injuries with size, color, location
  • ✓ Note who was present
  • ✓ Sign and date your documentation

DON'T:

  • ✗ Use judgmental language or opinions
  • ✗ Speculate or make assumptions
  • ✗ Confront suspected abuser
  • ✗ Promise client confidentiality (you must report)

Sample Documentation:

"1/15/2025, 2:00 PM - Observed purple bruises on client's left forearm, approximately 2 inches in diameter. When asked how they occurred, client stated 'My son grabbed me when I wouldn't give him money.' Client appeared frightened. Supervisor notified immediately. APS report filed."
